French-resident seafarers employed on board foreign-flagged vessels
The n° 2017-307 decree of the 9th of March 2017 has established the obligation for companies which employ French-resident seafarer on board of a foreign-flagged vessel to affiliate them to the French national institute for the welfare of seafarers (E.N.I.M) so they can benefit from a social security scheme.
Who is concerned?
It concerns French resident including residence in the French DOM (« départements d’Outre-Mer) and the overseas territory of Saint Barthélémy, Saint-Martin et Saint Pierre-et-Miquelon. The seafarer should not be affiliated to a social security scheme and must be onboard commercial vessels flagged outside the European Union, the European Economic Area, Switzerland or any third party state that is engaged in a reciprocal agreement for the coordination of Social Security Schemes with France.
The employer undertakes the obligation to affiliate the French resident seafarer to the French National Institute for the welfare of seafarers which is called L’E.N.I.M (in French : Etablissement National des Invalides de la Marine).
If the employer fails to complete this obligation, the seafarer can affiliate by himself to the E.N.I.M.
Failing that, the E.N.I.M will be able to make the affiliation systematically.
